The following decisions were made after the October 16 2012 discussion of industrial safety issues with Open Government experts:
I. On the draft federal law On Amending Federal Law On Industrial Safety at Hazardous Production Facilities and Other Legislative Acts of the Russian Federation
1. The Federal Service for Supervision of Environment, Technology and Nuclear Management (Rostekhnadzor) (Nikolai Kutyin) shall stipulate provisions making it possible to enact the federal law from March 1, 2013 and to re-register hazardous production facilities before January 1, 2014, when drafting the second version of the federal law On Amending Federal Law On Industrial Safety at Hazardous Production Facilities and Other Legislative Acts of the Russian Federation.
2. The Ministry of Finance (Anton Siluanov), in cooperation with the Federal Service for Supervision of Environment, Technology and Nuclear Management (Rostekhnadzor), shall look into the issue of increasing allocations to draft federal provisions and regulations in industrial safety, including with the use of the public-private partnership mechanism. The Ministry shall report the results to the Government.
3. The Ministry of Economic Development (Andrei Belousov) shall coordinate Draft Federal Law No 143415-6 On Amending Federal Law On the Purchases of Products, Works and Services by Certain Categories of Legal Entities and Draft Federal Law No 151498-6 On Amending Article 1 of Federal Law On the Purchase of Products, Works and Services by Certain Categories of Legal Entities with the federal executive agencies concerned. These draft laws shall exclude the enforcement of Federal Law No 223-FZ On the Purchase of Products, Works and Services by Certain Categories of Legal Entities with regard to the following legal entities:
Organisations whose revenues from regulated types of activity account for not more than 10% of total revenue from all types of activity over the preceding calendar year;Affiliated companies of organisations conducting regulated types of activity, in cases where the purchases made by the parent company account for not more than 10% of the annual income of the above-mentioned affiliated companies.
4. The Federal Agency for Technical Regulation and Metrology(Rosstandart) (Grigory Elkin) and the Ministry of Regional Development (Nikolai Slyunyayev), in cooperation with the federal executive agencies and organisations concerned, shall look into the application of international standards and compliance-confirmation documents in the implementation of unique technical and technological solutions on the Russian market, in order to eliminate barriers which hamper the implementation of investment projects.
5. The Minister for Relations with the Open Government Mikhail Abyzov, in cooperation with the federal executive agencies and organisations concerned and the members of the Expert Council under the Government of the Russian Federation, shall report to the Government on the preliminary results of enforcing the federal law On the Industrial Safety of Hazardous Production Facilities and Other Legislative Acts of the Russian Federation one year after the enactment of this draft law.
6. The Minister for Relations with the Open Government Mikhail Abyzov, in cooperation with the federal executive agencies and organisations concerned, shall discuss draft federal laws and regulatory documents stipulating the procedure for oversight and monitoring activity in environmental, construction and energy safety with the members of the Expert Council under the Government of the Russian Federation. They will also coordinate with federal executive agencies and organisations, with due account for experience gained from the discussion of the draft federal law On the Industrial Safety of Hazardous Production Facilities. The above-mentioned draft federal laws and regulatory documents shall eliminate unjustified encumbrances, and they shall also improve oversight and monitoring functions so as to make the Russian economy more competitive and to improve its investment climate. This includes the following draft federal laws:
No 584587-5 On Amending Certain Legislative Acts of the Russian Federation to Improve Standardisation Procedures in Environmental Protection and the Introduction of Economic Incentives for Legal Entities to Introduce the Best Possible Technologies;No 584399-5 On Amending the Federal Law On Industrial and Public Waste and Other Legislative Acts of the Russian Federation Regarding the Introduction of Economic Waste Management Incentives.
They shall report the results to the Government in the first quarter of 2013.
7. The Minister for Relations with the Open Government Mikhail Abyzov, the Ministry of Industry and Trade (Denis Manturov) and the Federal Agency for Technical Regulation and Metrology (Rosstandart) (Grigory Elkin), in cooperation with the federal executive agencies concerned and national employer associations, shall hold a discussion on the draft federal law On Standardisation in the Russian Federation with the members of the Expert Council under the Government of the Russian Federation, and they shall also draft a road map for its implementation.
They shall report the results to the Government before February 1, 2013.
