The United Nations Convention on the Use of Electronic Communications in International Contracts of 23 November, 2005 (hereinafter “Convention”) was signed by the Ministry of Communications and Mass Media in New York on 25 April 2007 based on Government Directive No. 1821-r of 27 December 2006. The Convention will be adopted in accordance with Article 20 of the federal law On International Agreements of the Russian Federation.
The aim of the Convention is to improve international trade by removing potential legal obstacles and clarifying vagueness regarding the use of electronic communications when concluding or executing contracts between commercial partners based in different countries.
The Russian Federation intends to adopt the Convention with a number of statements. In accordance with Clause 2 of Article 19 of the Convention, the Russian Federation will not be governed by the Convention in respect of contracts for which Russian law has established a notary form or requirement of state registration, as well as contracts to purchase or sell commodities that are restricted or prohibited from crossing the customs border of the Customs Union.
The enactment of the Convention will allow Russian business people to reduce the cost of organising and holding negotiations and signing foreign trade contracts with foreign partners.
