Resolution No 848 of September 26, 2013

The document has been prepared by the Ministry of Foreign Affairs.
The Agreement between the Russian Federation and the Republic of Estonia on the Russian-Estonian State Border and the Agreement between the Russian Federation and the Republic of Estonia on Delimiting Maritime Space in the Narva Bay and the Gulf of Finland were signed on May 18, 2005.
When ratifying the agreements, the Estonian side unilaterally included references to the expired Tartu Peace Treaty of 1920 between Estonia and Soviet Russia to the relevant Estonian law, which gave Estonia the opportunity to make territorial claims. In this regard, the signatures of the Russian government officials under the agreements have been withdrawn.
In the course of further negotiations with the Estonian side and work on the draft agreements, the Russian side insisted on accepting the wording which would prevent the Estonians from making territorial claims against Russia and preclude any political speculations about the so-called occupation of Estonia by the former USSR. The present versions of the draft agreements and Article 9 of the Agreement on the Russian-Estonian State Border meet these requirements.
The signing of the presented agreements will make the Russian-Estonian state border correspond with the actual location. The legalisation of the state border will serve as a legal obstacle for any territorial claims from Estonia against the Russian Federation.
