The document has been drawn up by the Ministry of Economic Development to implement clauses 3 and 4 of the action plan designed to implement the Federal Law “On the Contract System in the State and Municipal Procurement of Goods, Works and Services” approved by the Government instruction of May 21, 2013.
Clauses 19 and 23 of Article No 34 of the Federal Law stipulate the development of the resolution.
According to Clause 19 of Article No 31 of the Federal Law, if the initial (maximum) contract price for goods, works or services established by the Government is exceeded, the contract should provide for a supplier to give information to a customer on beneficial owners, the sole executive body of the company, the members of the executive board of the company, the head of the institution or unitary enterprise, or other legal entities taking part in the purchase by listing their full names.
According to Clause 23 of Article No 34 of the Federal Law, if the initial (maximum) contract price for goods, works or services established by the Government is exceeded, the contract must establish the responsibility for a supplier (contractor and executor) to provide information on associate contractors and subcontractors that have concluded a contract or contracts with a supplier (contractor and executor) whose price or the total price of which is over 10% of the contract price.
The resolution will provide for the timely implementation of the action plan and facilitate the Federal Law’s coming into effect on January 1, 2014.
