Currently, sports sailing vessels and leisure craft flying foreign flags cannot enter certain sections of Russia’s inland waterways due to the fact that after passing border, customs and other controls at a transit point in a sea port of the Russian Federation, in order to proceed to the required section of the inland waterways the vessel concerned has to cross the state border of the Russian Federation again and sail on the high seas or through the territorial waters of another state, thereby violating the requirements of Law of the Russian Federation No. 4730-1 of April 1, 1993 On the State Border of the Russian Federation. In that way, separate sections of the inland waterways open to navigation by craft flying foreign flags in reality remain closed to them.
The resolution was drawn up to remove this legal conflict and specify the details of Point 3 of the Rules of Navigation for Sports Sailing Vessels and Leisure Craft Flying Foreign Flags through the Inland Waterways of the Russian Federation, as approved by Government Resolution No. 472 of May 12, 2012. The draft resolution stipulates that sports sailing vessels and leisure craft flying foreign flags may pass border, customs and other controls at the nearest transit point, including one outside the sea ports of the Russian Federation.
The implementation of the resolution’s provisions will allow sports sailing vessels and leisure craft flying foreign flags to enter sections of the inland waterways adjacent to the inland waterways of a foreign state which are impossible to reach from the water area of a sea port of the Russian Federation. The implementation of the resolution’s provisions will promote the development of water tourism in the Russian Federation.
