federal law On Ratifying the Protocol On Certain Issues of the Import and
Distribution of Goods Within the Customs Area of the Eurasian Economic Union
(hereinafter referred to as Protocol, EAEU, respectively) was submitted by the
Russian Ministry of Foreign Affairs and the Russian Ministry of Economic
Development.
The protocol on the accession of Kazakhstan to the Marrakesh Agreement Establishing the World Trade Organisation of 15 April 1994 was signed on 27 July 2015 and ratified on 12 October 2015.
The Protocol On Certain Issues of the Import and Distribution of Goods Within the Customs Area of the Eurasian Economic Union (hereinafter Protocol) was drafted by the Eurasian Economic Commission in conjunction with executive authorities of Russia, Armenia, Belarus, Kazakhstan and Kyrgyzstan in order to reduce risks to the economies of the EAEU member states and the operation of the common market.
The Protocol was signed by the presidents of the EAEU member states at the meeting of the Supreme Eurasian Economic Council on 16 October 2015 in Burabai, Kazakhstan.
The Protocol establishes Kazakhstan's commitment to taking measures in order to prevent the export to the other EAEU member states of goods to which reduced customs rates apply in Kazakhstan. It also sets the provisions for the distribution of goods to which Kazakhstan may apply reduced customs rates under its WTO obligations, and the mechanisms of administration and oversight over the distribution of such goods.
The Protocol is to be ratified in accordance with Federal Law On International Treaties of the Russian Federation, as it contains rules that are different to those provided for by Russian legislation.
