In accordance with Clause 2 of Resolution No.
48 of the Supreme Eurasian Economic Council of 24 October 2013 On Measures
Listed in Addendum 6 to the Free Trade Zone Agreement of 18 October 2011
(hereinafter – Resolution No. 48, the Agreement), member states of the Customs
Union have a right to both joint and unilateral application and protection
(response) measures in foreign trade.
According to Addendum 6 of the Agreement, measures can be applied by introducing import customs duties in the amount equal to the most-favoured nation rate in respect of imports of goods from a country signatory to the Agreement, a country that joined integration associations with third countries, upon the existence of damages or the emergence of negative consequences for the respective industries.
The Russian side has identified a number of goods in relation to which the biggest risks of negative consequences arise for Russian producers due to the implementation of the Association Agreement concluded between Ukraine and the European Union on 27 June 2014. Belarus and Kazakhstan have confirmed Russia’s right to unilateral measures listed in Addendum 6 to the Agreement.
The Resolution stipulates the introduction of import customs duties on goods originating in Ukraine and imported to Russia in the amount of the rates of the Unified Customs Tariffs of the Customs Union, which are applied for imports from the countries enjoying the most-favoured nation regime. The decision to impose duties will be taken by the Government of the Russian Federation within ten days in the event that the Government of Ukraine takes action on the practical application of the economic part of the Association Agreement or its implementation.
