The document amending Government Directive No 2236-r of 1 December 2012 is aimed at bringing the action plan (roadmap) on Improving Registration Services for Real Estate, Title Deeds and Related Transactions (hereinafter referred to as the “roadmap”) in compliance with the form established for action plans (roadmaps) under Supplement No 2 to the Government Directive No 1613-r of 6 September 2012.
The directive includes roadmap performance indicators for the planning period (per annum), and also details the action plan envisaged in Government Directive No 1613-r of 6 September 2012.
Furthermore, the timeframe for carrying out certain initiatives was changed under the directive based on the 2013 results in implementing the roadmap.
Initiatives that are to be implemented through federal law have been split into stages replicating the legislative process in order to enhance efficiency and monitor the performance of the roadmap.
The directive also contains provisions on amending the roadmap’s Clause 13. The Ministry of Economic Development shall issue a regulatory act to approve the classification of permitted land use instead of having to seek legislative approval with respect to the classification of real property rights subject to state registration, categories of rights and limitations regarding real property, protected, conservation and other zones, zones subject to specific land use requirements, types of real property permitted use, and also the requirement to use such classifications in relevant situations.
The reason for introducing this amendment is that in accordance with Article 85 of Russia’s Land Code and Article 36 of the Urban Development Code permitted use of buildings, facilities and structures derives from the permitted use of the land plots where they are located and from which they are inseparable. The deadline for implementing this provision has been rolled back until August 2014 at the initiative of the Ministry of Economic Development.
Clause 13.1 has been added to the roadmap. It establishes a list of facility types that can be built (placed) without a construction permit and that are not subject to registration in the state real property cadastre.
Subclauses 6.2.2, 6.3.2 and 6.4.2 have been added to the directive at the initiative of the Agency for Strategic Initiatives to Promote New Projects autonomous non-profit organisation. Under these provisions, the Federal Service for State Registration, Cadastre and Cartography is required to issue regulatory acts containing a schedule for equipping offices that accept and issue documents with queue management systems, video cameras for real-time online streaming of the agency’s official website and audio recording equipment to track the interaction between agency employees and applicants.
