The Ministry of Industry and Trade has drafted this resolution to introduce the Custom Union’s technical regulations on food safety requirements.
Six technical regulations of the Customs Union came into force on July 1, 2013. They have established mandatory food safety requirements and forms of assessing compliance with them (as regards grain, fat-and-oil products, juices, several types of specialised foods, such as dietary products, food additives, flavouring products and alcohol) and the technical regulations of the Customs Union on the Labelling of Food Products.
According to the federal law On Technical Regulation (Item 3 of Article 46), products covered by these mandatory requirements are excluded from the uniform list of products subject to compulsory certification and the uniform list of products subject to declaration (endorsed by the Government’s Resolution No 982 of December 1, 2009).
To avoid confusion of customers as regards normative acts establishing mandatory requirements to products and related processes, including R&D, production, construction, mounting, adjustment, maintenance, storage, transportation, sale and disposal, the resolution excludes from the list of products subject to declaration 198 items covered by the technical regulations of the Customs Union.
The document makes it possible (pending the transitional period established by the decisions of the Eurasian Economic Commission on the entry into force of the Custom Union’s technical regulations) to sell food products in line with the earlier issued documents on compliance with safety requirements (without replacing the packaging and re-labelling these products) until the expiration date. As for the relevant documents issued after the publication of the relevant documents of the Eurasian Economic Commission, they will remain valid until February 15, 2015.
The implementation of the resolution will make it possible to tailor Russian law to the Agreement on Uniform Principles and Rule of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 and will not entail additional spending of federal budget funds.
