The draft federal law On Amending Article 19 of the Russian Federation Law On Protecting Citizens Who Were Exposed to Radiation in Consequence of the Accident at the Chernobyl Nuclear Power Plant has been drawn up by the Ministry of Labour and Social Security in execution of the Russian Constitutional Court’s ruling No 23-P dated October 24, 2012, which recognised the provisions of pp. 1, 2 and 4 of Part 2 of Article 19 of the federal law On Protecting Citizens Who Were Exposed to Radiation in Consequence of the Accident at the Chernobyl Nuclear Power Plant as inconsistent with the Constitution to the extent to which these provisions – within the meaning given to them by existing law enforcement practice – hamper the allocation of monthly compensation and annual paid leave to citizens who permanently lived/worked in the residence zone with a preferential social and economic status prior to January 1, 1991, left before December 2, 1995, and returned for permanent residence.
The draft suggests amending Article 19, with Part 3 extending to these citizens social support measures envisaged by pp. 1, 2, 4 of Part 2 of the article.
If signed into law, the draft will make it possible to provide social support to these citizens in keeping with the Constitutional Court's ruling.
The draft law will be considered at a Government meeting.
