The first meeting of the Coordinating Council for Relations with National Associations of Self-Regulated Organisations in the Construction Industry, chaired by Minister of Regional Development Igor Slyunyayev, was held at the Ministry of Regional Development today.
The meeting participants discussed the updated set of rules approved by the State Construction Committee’s resolution of December 10, 2012 that includes mandatory requirements and recommendations for engineering research in the construction industry.
Representatives of some construction companies voiced complaints about certain rules. The parties agreed that not all of the comments made by the construction community were included in the final set of rules; therefore, it was decided to draft a plan to revise these rules in accordance with established procedure.
In addition, the meeting participants discussed progress in implementing the revised Article 60 of the Urban Development Code which entered into force on July 1, 2013. The amendments are designed to increase the liability of developers and property owners for damage resulting from the usage of capital buildings. However, in this case, the system of shared responsibility stipulated by Federal Law No. 337 comes into conflict with the applicable regulations of the Urban Development Code in the part related to civil liability insurance of self-regulated organisation members, since the party which caused the damage is not liable, but rather the owner or developer, thus defeating the purpose of the existing insurance system. Draft Federal Law No. 262144-6, On Amending the Urban Development Code and Article 1 of the Federal Law On Amending Urban Development Code of the Russian Federation and Individual Legislative Acts of the Russian Federation, which establishes the subsidiary liability of self-regulated organisation members, seeks to remedy this legal contradiction. The draft law will be considered by the State Duma Committee on Land Relations and Construction at its meeting in September.
