A draft law On Introducing Changes to the Land Code of the Russian Federation and Certain Legal Acts of the Russian Federation, As Regards the Procedure for Allotting State-Owned and Municipally-Owned Land Plots, hereinafter referred to as draft law, has been submitted by the Ministry of Economic Development.
Currently, the legal regulations on the procedure for allotting land plots include many undefined details and discrepancies that create opportunities for misfeasance and violations of the law.
Specifically, various departmental laws and codes call for drafting documents, whose contents are either vague or insufficiently clear as legal grounds for establishing land plots. The issues of stipulating and changing the authorised land plot use procedure have been resolved in a contradictory and somewhat inconsistent manner. Moreover, current legislation stipulates no cases when it would be appropriate to allot a land plot without any tenders whatsoever.
Other issues have also not been legally resolved or need to be specified.
The draft law proposes improving the procedure for establishing and allotting state-owned and municipally-owned land plots, making this procedure as transparent and understandable as possible, providing equal access to land resources for all investors and reducing the number of excessive approvals.
