On submitting a draft law to the State Duma aimed at improving labour relations in art and culture

The draft federal law On Introducing Amendments to the Labour Code of the Russian Federation to Improve the Labour Relations of Those Who Work in Cinematography, Theatres, Theatrical and Concert Organisations, Circuses, and Other Individuals Involved in Creating and/or Performing/Exhibiting Artistic Works has been developed by the Ministry of Culture under Clause 2 of the Prime Minister’s List of Instructions dated December 6, 2011, following the meeting with key figures in theatre on November 30, 2011.

 

The draft law adds to the Labour Code Chapter 521 Specifics of Regulation of Labour Relations of Those Who Work in Cinematography, Theatres, Theatrical and Concert Organisations, Circuses and Other Individuals Involved in Creating and/or Performing/Exhibiting Artistic Works.

This chapter provides for the mandatory selection of candidates on a competitive basis for concluding a job contract for an indefinite period for a particular job position, as well as the procedure for the selection. However, the draft law stipulates that every fifth year there should be a new running for this job position. The person currently holding this position can run for the job together with other candidates.

If the person is not selected from among the other candidates or refuses to run for the job, his or her job contract can be cancelled.

The regulations on the procedure for filling job positions, as well as the List of Job Positions of those working in the arts are approved by the federal executive body authorised by the Government. The aforementioned regulations will cover the procedure for trade union participation.

The amendments under the draft law will not affect those who work in the media because media editorial boards, including TV, already require a competitive selection process and fixed term job contracts.

The regulation of those employed in the media, TV and film will be covered by the Labour Code, Article 351.
