On introducing amendments to the Rules on Determining a Financial Organisation’s Dominant Position (Excluding Credit Institutions)

The resolution is intended to harmonise the Rules on Determining a Financial Organisation’s Dominant Position (Excluding Credit Institutions) with the Federal Law On the Protection of Competition.

Clause 6 of Article 4 of the Federal Law On the Protection of Competition has been amended to include microfinance organisations in the category of financial organisations.

Accordingly, in the Government Resolution On the Approval of the Terms of Recognising a Financial Organisation’s Position as Dominant (Excluding Credit Institutions) and of the Rules of Determining a Financial Organisation’s Dominant Position (Excluding Credit Institutions), the main indicator needs to be defined, which will be used in calculating the amount of financial services in the commodity market in order to determine a microfinance organisation’s dominant position. The document establishes the amount of microloans extended by a microfinance organisation as such an indicator.
