Under Article 9 of the September 26, 1986 Convention on Early Notification of a Nuclear Accident, hereinafter referred to as the Convention, the member states shall, whenever necessary, conclude bilateral or multilateral agreements on the subject matter of the Convention. The Convention stipulates the notification of states in case of a nuclear accident at an installation or in the course of activities involving the use of nuclear energy, which entailed or may entail a transboundary emission of radioactive substances into a neighbouring territory.
The Convention defines installations and activities as follows:
· any nuclear reactor, regardless of location;
· any installation related to nuclear fuel cycle;
· any nuclear waste treatment installation;
· transportation and storage of nuclear fuel or radioactive waste;
· production, use, storage, removal or transportation of radioactive isotopes for agricultural, industrial or medical purposes, as well as for conducting research in these areas.
The Agreement stipulates various cooperation terms between the Russian Federation and Ukraine in case of a nuclear accident linked to installations or activities involving the peaceful use of nuclear energy, as well as information exchanges on the condition of nuclear and radiation safety, including in an event of a deterioration in the radiation situation relevant to the radiation safety standards being registered other than one related to a nuclear accident.
The Agreement sets forth the procedure for exchanging classified information and makes it incumbent upon the related agencies of the parties to compile a list of installations that would be covered in an information exchange.
The related agencies responsible for implementing this Agreement shall be the Rosatom State Nuclear Energy Corporation of the Russian Federation and the State Nuclear Regulatory Inspectorate of Ukraine.
